If the Roberts' Computer Repair Service Requester does not lodge any complaints within three days of the service's completion, Roberts' Computer Repair will record the service as closed and transmit the agreed-upon payment to the online account of the Roberts’ Computer Repair Service Professional. It is necessary to make the Service Payment via the Web Service provided by Roberts-Repair.com. Cash payments made for services rendered through sources other than the Roberts-Repair.com website do not qualify for refunds. However, reimbursement expenses incurred by a Roberts' Computer Repair in the course of performing a Service may be settled offline in cash or via the Roberts-Repair.com Web Service.

Release

Billing and payment policy

Arbitration. If you and Roberts-Repair.com are unable to resolve a dispute via informal talks, either party may choose to have the dispute (except those disputes specifically excluded herein) ultimately and solely settled by binding arbitration. Any decision to resolve a dispute via arbitration made by one party will be conclusive and obligatory for the other party. By choosing arbitration, both parties agree to waive their right to pursue legal action in court or have a trial by jury. The arbitration process will follow the Commercial Arbitration Rules (the "AAA Rules") of the American Arbitration Association ("AAA"), along with the AAA's Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), which can be found on the AAA website at www.adr.org. The costs you are required to pay for arbitration and the amount you will contribute towards compensating the arbitrator will be determined by the AAA Rules (and, if applicable, restricted by the AAA Consumer Rules). If the arbitrator determines that these prices are exorbitant, Roberts-Repair.com will cover all arbitration fees and expenses. The arbitration may be carried out using several methods, including in-person meetings, document submissions, phone conversations, or internet platforms. The arbitrator will provide a written ruling, but is not obligated to offer a statement of reasons unless specifically asked by one of the parties involved. The arbitrator is required to adhere to relevant legal provisions, and any decision made by the arbitrator may be contested if they fail to comply with such provisions. Unless stated otherwise in this Agreement, both you and Roberts-Repair.com have the right to bring a lawsuit in court to enforce arbitration, halt legal proceedings until arbitration is completed, or to validate, alter, annul, or issue a ruling on the award given by the arbitrator.

Instances when Alternative Dispute Resolution does not apply. You and Roberts-Repair.com both acknowledge that the aforementioned provisions regarding informal negotiations and binding arbitration do not apply to the following Disputes: (a) any Disputes that aim to enforce or safeguard, or pertain to the validity of, any intellectual property rights belonging to either you or Roberts-Repair.com; (b) any Dispute that is connected to or arises from allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim seeking injunctive relief.

Limitations. You and Roberts-Repair.com both agree that any arbitration will only pertain to the specific dispute between Roberts-Repair.com and you as an individual. Under the law, it is not allowed to combine arbitration with any other legal proceedings. Additionally, there is no permission or power to arbitrate a dispute as a class-action or to use class action procedures. Furthermore, there is no permission or power to bring a dispute on behalf of the general public or any other individuals in a supposed representative capacity.

Location: The arbitration will be held in a suitable location within the United States that is convenient for you.

Severability: You and Roberts-Repair.com acknowledge that if any part of the section named "Dispute Resolution and Governing Law" is deemed unlawful or unenforceable, that specific part will be removed and the rest of the section will remain fully valid and enforceable. If the subsection titled "Exceptions to Alternative Dispute Resolution" is determined to be illegal or unenforceable, both you and Roberts-Repair.com will not choose arbitration for any dispute falling within that part of the subsection. Instead, such a dispute will be resolved by a court with the necessary authority, and both you and Roberts-Repair.com consent to the jurisdiction of that court

Special promotions

Roberts-Repair.com may from time to time provide certain promotional opportunities to Roberts Repair Service Requesters All promotions will be run at the sole discretion of Roberts Repair, Inc., and can be activated, modified or removed at anytime by Roberts-Repair.com without advance notification.

In the event that you are given a code by or on behalf of Roberts Repair through which you may refer a friend to Roberts Repair in exchange for a referral credit, you shall not use any online marketing or advertising to promote such code or to artificially increase the amount of credits awarded. By way of example, you may not post, or cause, request or permit a third party to post any such code on a coupon website, nor use any paid search marketing, online advertising, forum posting, newsgroup posting or bulk email to disseminate such code. You may only share such code with your personal friends and acquaintances for legitimate referral purposes, as determined by Roberts Repair in its sole discretion. Without limiting Roberts Repair’s other rights and remedies, Roberts Repair may terminate such code and/or your account for any breach of this Section.

No agency

This Agreement does not seek to create or establish any independent contractor, agency, partnership, joint venture, employer-employee, or franchiser-franchisee relationship.

General provisions

Roberts-Repair.com's failure to enforce any term(s) of this User Agreement will not be interpreted as a waiver of such provision or right. This Agreement is the whole agreement between you and Roberts-Repair.com on the subject matter at hand. In the event that any part of this Agreement is determined to be invalid or cannot be implemented, the other parts will be enforced as far as practicable, and the other parts will continue to be fully effective. This Agreement shall inure to the benefit of Roberts-Repair.com, its successors and assigns.

Changes to this agreement and the service

Roberts-Repair.com has the right to alter, amend, append, supplement, or remove any terms and conditions of this Agreement (including the Privacy Policy) at any time, in its own discretion, with or without previous notification. If any future modifications to this Agreement are not satisfactory to you or result in your non-compliance with this Agreement, you are required to cancel your usage of the Service immediately. By continuing to use the Service after any modifications to this Agreement, you are fully and permanently accepting all of these changes. Roberts-Repair.com has the authority to alter, adjust, halt, or terminate any element of the Service at any given moment. Roberts-Repair.com has the right to place restrictions on certain features or limit your access to some sections or the whole Service, without providing prior warning or assuming any obligation.
